The European Union has officially implemented a requirement for mandatory labeling of AI-generated content.
This rule specifically pertains to photographs, audio recordings, and videos created or modified using artificial intelligence that depict real people, places, objects, or events. Additionally, texts generated by AI on topics of public interest that have been published without human editing are also subject to labeling.
The established requirement does not apply to auxiliary AI systems, such as photo editing programs or spell checkers. Exceptions also include materials that are "clearly artistic, creative, satirical, or fictional" in nature.
The obligation to label falls on both AI content providers and users who apply such content in commercial or professional activities. This includes authorities, media outlets, companies, public associations, and influential professionals (influencers).
In case of violations of the specified rules, companies face fines of up to 15 million euros or up to 3% of their annual global turnover. The maximum fine for EU institutions, agencies, and bodies is set at up to 750,000 euros. For small and medium-sized enterprises, penalties will be calculated based on the principle of proportionality.
