According to the amendments made to the Civil Code in 2021, a specific deadline was set for the registration and application for the legalization of unauthorized constructions built before the law was amended. During the same period, the legislator also established that all unauthorized constructions built after the amendment of the law would no longer be subject to legalization.

According to Armenpress, this was stated by Nane Ghazaryan, Deputy Head of the Cadastre Committee of the Republic of Armenia, during an extraordinary meeting of the Permanent Committee on State-Legal Affairs of the National Assembly, where she presented for the first reading a package of bills on amendments and supplements to the law on the Civil Code of the Republic of Armenia and related bills.
The speaker noted that the absence of the possibility of legalizing unauthorized separate constructions under the current legislation after the adoption of the law does not always stem from public interest. In particular, there are cases where the demolition of such constructions may lead to the loss of already created economic and social value, while their legalization, under compliance with relevant requirements, will contribute to clarifying the legal status of the property, expanding economic circulation, increasing revenues for tax and local budgets, as well as ensuring the integrity of the real estate registration system.
"A deadline will be set for the legalization of unauthorized constructions until December 30, 2027. At the same time, conditions will be established for inclusion in the list of unauthorized constructions subject to legalization approved by the Government, and further legalization, including the presence of the relevant license and a positive conclusion from a person or organization with an investment, the preliminary assessment conducted by the competent authority, as well as the payment of the local fee established for legalization," the speaker stated.
The draft also proposes to establish new types of local fees for the legalization of unauthorized constructions. According to the draft, in Yerevan and the communities adjacent to the capital, a triple fee will be charged for the processing of documents established by law for the legalization of unauthorized constructions, as well as a one-time local fee of 100 million drams. In regions and communities not adjacent to Yerevan, the same fee will be 50 million drams.
Members of parliament raised questions regarding the justification of fee amounts, consideration of cadastral values in the project, the number of illegally constructed buildings, and their registration possibilities. The speaker provided detailed answers to the questions, emphasizing that the state does not encourage the construction of unauthorized buildings, as evidenced by the establishment of higher local fee amounts within the framework of this legal regulation.
