Gagik Khachatryan’s Lawyers Apply to the ECHR

Lawyers say the detention ruling has still not been provided after 27 days, blocking the right to appeal.

Lawyers for Gagik Khachatryan say the court ruling ordering his detention has still not been provided to either him or his legal team 27 days later. The defense argues that this breaches rights protected under Article 5 of the European Convention on Human Rights.

On September 2, 2026, Armenia’s Anti-Corruption Court ordered Khachatryan held in pre-trial detention for two months, granting a motion filed by an investigator from the Investigative Committee. According to the report, the motion said he could evade the investigation, influence the criminal case or commit a new offense.

The defense disputes that reasoning, saying Khachatryan’s severe medical condition is documented by multiple medical panels. The lawyers also note that on June 5 and June 7, 2026, the court rejected earlier detention requests and, from June 5 to September 2, he did not attempt to hide, obstruct the investigation or commit a new crime.

According to the defense, Khachatryan is being held at Yerevan-Kentron penitentiary and lacks minimum conditions needed to protect his health, including important disability-related accommodations. They also say he has not been allowed to be examined by a doctor of his own choosing. Without the court’s written ruling, the lawyers say, he has effectively been denied the right to seek a special review.

The defense said an application has been filed with the European Court of Human Rights on Khachatryan’s behalf. The filing challenges the lawfulness of his detentions and imprisonment, as well as the effectiveness of judicial review.
